Therms of Use

Preamble

These general terms of use specify the rights and duties of the members and users of SoCompetent website. Members post skills and/or jobs on the website. These jobs and skills can then be consulted by the members of SoCompetent website. Skills represent the ability of the person to do a job. They have knowledge on a matter and they can refer a member of the site to do it for him/her. Jobs consist in a person stating a need for a specific job to be done.

ARTICLE 1: Acceptance conditions

To be granted access to the site and to create your profile, you must accept the General Terms of Use. You cannot use SoCompetent website if you do not accept the General Terms of Use or if your account is temporarily or definitely removed. No third party is allowed to use your account or profile. SoCompetent does not check the profiles of its members and cannot confirm the personal details of the candidate posting a job, or the job itself.

ARTICLE 2: Description of SoCompetent service

SoCompetent is an online medium accessible via the Internet and allows members of the site to make restricted contact between themselves. SoCompetent publishes a list of very different jobs and skills and allows for contact between users of the website posting skills and those posting jobs.
- We do not set rates for contractors,
- We do not draft any work contract between the parties,
- We do not influence on profile or skill selection,
- We do not check the contents of jobs, skills and profiles,
- We are not bound to due care or results.

ARTICLE 3: Privacy protection and anonymity

Profiles and jobs posted under their own responsibility by the users, must show no indication regarding age, gender, origin, religion or disability.
Some of your personal details are restrictedly communicated to third parties and used by them or us. By accepting the General Terms of Use of our services, you certify that you accept that the following personal details be used and communicated to third parties:
- Member name,
- Email address.

ARTICLE 4: User accounts

You commit to grant SoCompetent unlimited access to all your personal details available in your user account. Members using SoCompetent service compile and create under their own responsibility their own profile and the information related to this profile.

ARTICLE 5: Behaviour of SoCompetent members

You commit to the accepted standards of good behaviour and to behave responsibly on SoCompetent website. It is not allowed that the SoCompetent online medium can be used in any other intent than searching for and connecting skills and jobs.

ARTICLE 6: Compliance with the law

Members of SoCompetent service, in accepting the General Terms of Use, are bound to comply with any laws, regulations, standards in force of any kind, and also with the General Terms of Use relative to the use of our services. Any content present or posted on SoCompetent website is deemed the property of SoCompetent.

ARTICLE 7: Compensations

No member of SoCompetent website may take legal action against the operators of this website for any reason whatsoever, as the latter are not liable for any contractual dispute or any other kind that could arise between users that were put in contact via the website. Any member that would however take legal action against SoCompetent commits to indemnify the operators of this website, provided that such initiative be deemed as abuse or unfounded by the Courts, to which the case was referred, for example, in the event of a breach of the General Terms of Use, laws or regulations in force.

ARTICLE 8: Personal details

The information you post on SoCompetent online medium:
- Must not be false, untrue, wrong, incorrect,
- Must not mislead a user in any way whatsoever,
- Must not morally or physically harm any person accessing this information,
- Must not harm copyrights, patent or brand owners, intellectual property rules, trade secrets, rights to publish or privacy of third parties,
- Must not infringe the laws and regulations,
- Must not be libellous, slanderous or malicious,
- Must not be discriminating, encourage violence, racial, religious or ethical hatred, and must not praise war crimes,
- Must not include any obscene or pedophile contents,
- Must not contain any virus or any other kind of nuisances considered as such, intended to damage any computer-based system,
- Must not contain any hyperlinks to services other than that offered by SoCompetent,

The following types of job ads are prohibited on the site:
-multi-level marketing or pyramid schemes
-business or job opportunities that require upfront or periodic payments

Any member discovering, while browsing SoCompetent website or exchanging messages/information, that some contents posted are libellous or information prohibited on the website (cf list above) must immediately notify the website administrators via the "Contact us" section.

ARTICLE 9: Termination

You acknowledge that SoCompetent can at any time cancel your user account and access right in case of prolonged non-use of the service, breach of the conditions of use, non-observance of laws and regulations, fraudulous actions, non-observance of accepted standards of good behaviour or any other rightful reason (terms of abuse, hatred, etc).

ARTICLE 10: Warranties

You acknowledge and accept to use SoCompetent service "as is" and at your own risk. We do not guarantee the truth of any information entered by users and indicated in user profiles and we do not guarantee continuous integrity of the contents and service. We do not commit to provide you with a service free of incidents, service interruptions, errors. Lastly, Socompetent denies any responsibility relative to information, texts, articles, jobs that can be consulted on this website and created or issued by third parties whatsoever.

ARTICLE 11: Disclaimer

SoCompetent is only an online medium, therefore we do not take any part whatsoever in the contractual relations created or agreed between members or between a member or a third party. SoCompetent shall not be liable for the contents of the jobs/skills, for the real skills of users and for the truth of the jobs offered and posted by members. SoCompetent shall not be liable in any way whatsoever as a result of members getting in contact and during job performance.

ARTICLE 12: Control of information entered by members

We do not control in any manner whatsoever the information communicated between members or the truth, quality level or contents of the jobs posted, or the ability of the members to perform the jobs. We never take any part whatsoever in contract agreement and signing between users of SoCompetent service. Lastly, we do not control the information or contents exchanged in emails between users.
For any information exchange via email or any other medium offered by SoCompetent, you are solely responsible for what is written by the user and for the personal details (last name, first name, address, telephone…) that he/she posts.
SoCompetent only acts as an electronic medium and/or passive intermediary in publishing this information. SoCompetent previously declares all information relative to users to CNIL.

ARTICLE 13: Description of proposed skills

The member must enter true and precise information on his/her skills. These skills must not mislead users and must reflect his/her real ability.

ARTICLE 14: Description of seeked jobs

The member must provide on the website a truthful and precise description of the job corresponding to their needs. These jobs must be clear, precise and self-explanatory so that users can understand and respond to them.
You are solely responsible for the contents, description and category of the jobs you post on SoCompetent website.

ARTICLE 15: Declaration to CNIL

The information collected is subject to automated computer processing. In accordance to the French "informatique et libertés" law of January 6, 1978, you have the right to access and correct the information relative to you. If you want to exercise this right and be communicated the information relative to you, please contact us.

ARTICLE 16: Legal demands

The profiles compiled by users upon registration are kept fully confidential, except for the information indicated on the website and used to describe the jobs offered or seeked. The personal address of users is also kept strictly confidential and will never be disclosed on the website.
We respond any requests from legal authorities and third parties in observance of laws, intellectual property rights or any other rights. We can, and you give us permission to, communicate any information relative to you to legal or administrative officers. Such communication will take place whenever deemed necessary by the authorities and in the scope of investigations on any illegal activity for which we may be liable.
It is strictly prohibited to send unsolicited marketing messages to other members. You shall not communicate personal details of other users to third parties without previous permission from us and the users concerned.

ARTICLE 17: Video

You have chosen to upload an image (photograph, drawing, etc.) and/or a video to promote your service on the SoCompetent Platform, with the aim of illustrating your activity and/or to introduce yourself.

You consequently authorize SoCompetent to use this image and/or this video so that it appears on the various media used to promote your service on the SoCompetent Platform.

You also authorize SoCompetent to use this image and/or this video in the context of promotional campaigns about the SoCompetent Platform. As SoCompetent does not check the content of this image and/or this video, you acknowledge that you have sole responsibility for its publication. In particular, you will refrain from :

attacking human dignity through images, videos and/or sentiments that are racist, violent or pornographic in nature, or deny the holocaust
breaching another persons right to privacy
using images and/ or videos for which you do not hold the rights or which require prior authorisation from a third party
Finally, generally speaking, using images and/or videos infringing any third-party rights or intellectual property.

If you decide to add a photograph and/or a video of yourself, you authorise SoCompetent to use and distribute it. This authorisation is personal and non-transferable. It only applies to the listed media types. It can be revoked at any time by modifying your SoCompetent account, in the account management area.
